In this document TIC means Things in Common Limited
Borrowing Agreement
1. Borrowers must be 18 or over
2. To the satisfaction of TIC, borrowers must a) agree to the terms of the borrower agreement (this document) b) provide photo proof of ID c) provide proof of address and d) register a payment card
3. Personal data will be held in accordance with current UK legislation.
4. By borrowing an item the member certifies to TIC that they are capable of using that item in a safe and proper manor.
5. Only the Borrower may use the tools lent to them, unless with express permission of TIC.
6. All items borrowed must be returned before the specified time on their due date
7. Borrowers are responsible for paying all fees connecting with the loan of things including fees and costs if things are returned a) late b) dirty or unclean c) damaged up to the cost of replacing the item plus reasonable administrative costs.
8. TIC reserves the right to use appropriate steps to retrieve tools or unpaid fines and fees, including the use of legal actions and charge the Borrower the full costs of such action, plus reasonable administrative costs. TIC reserves the right to forgive, suspend or collect fees in full or part its discretion. Any fees not settled within 14 days will be charged at the full cost of the item(s) plus any reasonable administration costs and fees.
9. All parts of any item(s) must be returned to TIC for the whole of the item(s) to be deemed to be returned. For example, don’t return the drill without the battery! Any thefts must be reported as soon as possible to TIC, and the items are deemed as remain in the possession of the borrower until such time as they are reported or recovered.
10. Reserving an item does not mean that it will be available to be borrowed at the time advertised, and TIC can not accept any costs associated with losses that this causes – other borrowers may be late returning things or require fixing. Also, TIC can’t be held responsible for any losses, expense or inconvenience that this causes.
11. If any item becomes unsafe, the Borrower must immediately discontinue the use of the tool and notify TIC of the issue and return the item as soon as possible. The borrower will only use the tool for the purpose intended
12. Normal wear and tear accepted, the Borrowers agrees to pay for the loss of, or damage to, any item and agrees to accept TIC assessment of condition of items, acting reasonably. The Borrower agrees to the assessment by TIC of fair restitution for damage, delinquency and/or loss or items in part or in total. This restitution could equal the full replacement cost of the item, plus reasonable administrative fees.
13. All items must be returned cleaned and in the packaging provided, with any ancillary documentation, handbooks or guidance notes etc. The Borrower agrees to pay any cleaning fees or charges deemed to be necessary by TIC acting reasonably.
14. TIC reserves the right to refuse any loans of any items at its discretion
15. Borrowers unsure how to operate any item or feel they need training, must make arrangements with TIC for training and/or a demonstration prior to using the item they have borrowed.
16. Any borrowing rights can be terminated at any time at the sole discretion of TIC, and will be withdrawn in cases of abuse, harassment, non-payment of fees, malicious damage, and, health and safety
17. Items can be borrowed for personal, social and domestic use only.
18. At the discretion of TIC some items may be lent with supplementary items. Where items are lent in sets or with supplementary items, the loss or damage to any part may mean the costs of the whole may be due. E.g a specific charger, maintenance tool etc
19. We do not provide consumables, e.g. sanding pads, drill bits, screws etc. Where these are provided, TIC does not accept any liability resulting from their quality. These items are sometimes donated and in no way is providing them an endorsement of their quality or suitability.
20. Any monthly fee paid is a membership fee, and doesn’t constitute a payment to borrow any particular item at any specific time. Members only become borrowers by borrowing items
